Welcome and thank you for joining me. I am Gerry Oginski in New York Medical Malpractice and Personal Injury Accident Attorney practising law here in the State of New York. This is a series of video tips that I am providing to you, to help you understand how accident cases in New York work.
Here is another tip on how insurance companies like to lowball injured victims and try and settle cases on the quick and cheap. Insurance companies love to deal with inexperienced people. When I say inexperienced, meaning that they don't have much experience negotiating with an insurance company.
They have never handled an accident case before. They don't what documents are necessary in order to justify and support a significant compensation award and when the insurance company sees that they are dealing with somebody who is not experienced, they know that they can save thousands and thousands of dollars and make you feel like you are getting the best deal in the world.
Well, why would somebody want to do that? They would want to do that because they are afraid of hiring an attorney and having an attorney take a percentage of whatever money is recovered. Thinking that, Hey! I can build a house on my own, I can do a construction project on my own, I can fix my own car. There is no reason why I can't learn everything I need to, in order to negotiate effectively with the insurance company. And you know what, if you have been aware with law and the knowledge and the experience to do that, you probably can do that on your own.
However, the majority of people don't have that ability and rely on an experienced Accident Attorney in New York to do that for them. If you have never negotiated a case on your own, involving injuries arising out of an accident with an insurance company, how are you able to intelligently determine the value of your injuries and compare them to the injuries that somebody else suffered in the same town you live in or in the same county you live in or maybe even another adjacent county.
Because if you cannot obtain that information and don't know the true value of your injuries, then you are doing yourself a disservice because the insurance company is going to know and have that information in front of them. They are not going to share it with you but they are going to use that against you. Because whatever number you come up with, they are going to tell you that that number is way too high and there is no way that they could ever pay that kind of number.
Well, how do you respond to that? Without having the knowledge and experience and documentation that you will need to support your claim. To show that you have significant injuries, you are going to be at a significant disadvantage. So that's why I always recommend that you at least speak to an experienced attorney, even if you choose not to hire an attorney. At least talk to an experienced lawyer to find out what you may need to do in order to support your claim if you are going to try and negotiate your accident case yourself and that's it for today's video tip.
