Gerry Oginski: Welcome and thank you for joining me. I am Gerry Oginski in New York Medical Malpractice and Personal Injury Trial Lawyer practicing law here in the state of New York. Today's topic is about bus accidents. What happens if you get hit by a bus while crossing the street?
Well, in most cases in New York, bus is usually operated by a Transit authority. Those Transit authorities tend to be Municipal authorities. Why is that important for you to know? It's important because Municipal agencies have a much shorter time period in which you to file a claim against them. Typically, you only have 90 days from the date of the accident in which to file a claim. Then you will only have about a year and 90 days from the date of the accident in which to file law suit.
So, sometimes the victim will call the office and say, 'It's been 2 years since my accident. I want to know if I can bring a case'. The problem is, with a lot of the bus authorities, it becomes impossible, once the time has lapsed, to bring a case for your injuries.
That is why it is so critical that when you have been involved in some type of bus accident, that you speak to an attorney right away to find out how you go about filing a claim to protect your rights. Then, you have some additional time in which to evaluate the full extent of your injuries, before you go ahead and file a law suit.
