Gerry Oginski: Welcome and thank you for joining me. I am Gerry Oginski, a New York Medical Malpractice and Personal Injury Accident Attorney practicing law here in the state of New York. For those of you who have been involved in a car accident, I want to tell you about a great way that insurance companies go about, trying to save thousands and thousands of dollars to get you to settle your personal injury accident claim.
The insurance company rep, will want to talk to you to find out what your injuries are. They will want to know, whether you are still under going medical care. Whether, you had hospitalization. Whether, you need surgery. Whether, you need physical therapy or rehabilitation therapy or whether, you need ongoing medical intervention. And why do they do that? Because they want to know what the risk is from a financial stand point on their end. As to whether, they are going to have to ultimately pay you, assuming that they have liability for your injuries and if they can try and limit the amount that they are going to pay you by offering a quick settlement now, it's in their interest to try and do that. I have seen many times, where an insurance company feels that they have liability and that there are documented damages and injuries.
They will simply cut a cheque without being asked, in the hopes that you will see a nice big cheque and take it and sign it and cash it. And once you do that, you are affectively giving up your right to bring a law suit and seek compensation for more, then whatever it is that the insurance company is offering you. That's one way that the insurance companies saves thousands ans thousands of dollars by settling a case early, without you even asking them for a dime. Plus, shortly after the accident, you may not know the full extent of your permanent injuries. You may not know whether you will need a surgery in the future or what type of therapy you are going to need and as a result of that, you are going to be speculating. That you will not need those additional treatments, just because you see a nice cheque in front of you. My advice is before you ever cash that settlement cheque, speak to an experienced attorney and find out if this the right thing for you. In some cases, it might be and in other cases, you will see that it is totally inappropriate and insufficient compensation for your injuries. And that's it for today's video tip.
