Shalom! I am Rabbi Jonathan Ginsburg of the Ezra-Habonim, Niles Township Jewish Congregation in Skokie Illinois. This video is about Jewish divorce.
First of all, it is permitted. The Torah says in Deuteronomy chapter 24, he rights for her a bill of divorced. The good news is that for those marriages that are not sustainable and workable, divorce is permitted in Judaism. The bad news is that our sages have always interpreted that language to say that he has to give to her a divorce, that the man has to initiate it, he has to participate.
Now, the conservative Rabbinate has a mechanism, if the man is recalibrated, refuses to participate. First of all Talmud says you can pressure the guy. Any situation loans for a fellow refuse to give his wife to get. He was associate in law firm. I called the senior partner, it happen to be Jewish and he told me not to worry, it would be taking care off. That get was signed the permission to do to get the was signed the next day.
But if that is not the case, we do have a mechanism called (foreign language) nullification of the betrayal. It does not jeopardize the status of the children and it is permitted by the Talmud. The Orthodox do not allow it. So, it all only be undertaking by a conservative Rabbi.
Now, in terms of they get the process is you go to a Rabbi, who is authorized to do it. The conservative movement has about 13 Rabbis around the country in various cities that we all use because it requires certain scribblers skills and knowledge. Most the Orthodox communities is assume have a bait team that are real prepare one.
Then the husband agrees, the woman agrees, and that get as a fact that there are various ways of delivering it. You can handed to our, in some casesm neither can be present or only one could be present. There is various ways to do it. It is an ancient Aramaic of document of 13 lines, prepared specifically for that case.
Then as soon as the get is authorized the Jewish divorced then the people get a notice that they are free to remarry. I believe that the reform Rabbis do not require a Jewish divorced. They believed in the principle of (foreign language), that that are civil law of the land is the law. Therefore, if the civil society gives a get the none Jewish divorced than that is all they need. The problem with that is, that when a Rabbi does a wedding, we do it not only by the authority of the secular state but also the line we say is that “we knew marry you according to the Laws of Moses in the people of Israel also.” and if you get married by the laws of Moses in the people of Israel, you should get divorced that way.
If two Jews marry and do not get a Jewish divorced according to conservator and artifacts Rabbis they are still married. And if they should marry someone else, that could jeopardize the status of the children. So, it definitely encourage Jewish couples getting a divorced to get a Jewish divorced too. It helps everybody and solves a lot of problems down the road. You do not want to jeopardize the status of any future children if possibly.
And now, in addition to that, their simpler ways to do it there is a nicer way to do it nowadays than kind of the drudgery of the old fashion religious tribunal which could cost a lot emotional anguish. There is also some nice readings that people do following the divorce. Sometimes women go to the Mikfa to have a kind of a cleansing experienced.
Now, what if a Jew and a none Jew marries there is a different opinions but in general it is not considered necessary to have Jewish divorced in that circumstance. In any case, consult your Rabbi. Hope this helps explain some of the basic rules about Jewish divorce.
