Today, I want to talk to you about what to do when you’ve made a really serious mistake like getting arrested for driving under the influence. I’m Stefanie Schaeffer and this is Know Your Rights TV.
The laws concerning drunk driving vary from state to state. But there’s some basic things you need to understand. First, the Miranda Act requires that police advice you of your right to the time of your arrest unless of course, your presence is causing a threat to public safety. You have the right to remain silent. In fact, anything you say will most likely be admissible in court. You also have the right to an attorney. And the police must inform you with the charges brought against you. You’re also entitled to a phone call.
Perhaps best use to retain an attorney. Please, don’t represent yourself unless you know what you’re doing. You have the right to a prompt hearing and a speedy trial. You’re also entitled to a bail hearing. Most DUI attorneys would never tell you to plead guilty unless you’re getting something in return and all parties know a trial is expensive and time consuming.
A good DUI attorney will attempt to extract as much as possible from a judge or prosecutor in exchange for his or her client’s guilty plea. Plea bargains usually include promise of a reduced sentence or a reduction in charges like reckless driving instead of a DUI. Sometimes, it even includes the dismissal of one or more counts.
