Okay folks, it’s a dirty little word, lawsuit. I know I know too many lawyers, too many lawsuits but the truth of the matter is you have every right to sue to get what’s owed to you and you can do it without a lawyer. Today we’re talking about knowing your right in Small Claims Court. I’m Stefanie Schaeffer and this is Know Your Rights TV.
Small Claims Courts allow people to sue others from modest amounts of money while acting as their own legal counsel. Some examples of Small Claims Court actions might be contract violations, property damage disputes, defective merchandise, or bounce checks.
Before filling a claim in Small Claims Court, you must be 18 or older and the person you’re suing also has to be 18 or older. Complaint forms are usually available through the local court. You pay a small non-refundable fee and the court sets a hearing date. A mediator will usually try to get both parties to see eye to eye, reach some kind of an accord. If that’s not successful, the case will generally advance to hearing before a judge usually on the same day. Keep in mind that even if you do when, you’ll still have to collect your debt from the other party.
